Creation, Perfection and Enforcement of Liens

There are several types of liens that encumber property. You may have an existing tax lien or a lien as the lender for secured property, such as a mortgage. It is also possible to create a judgment lien by suing the debtor for payment. You can also file a construction (mechanic's) lien in cases of nonpayment for construction services.

Our attorneys can also assist you with the important step of perfecting the lien by filing it to serve as notice against other creditors. We can check records to make sure that no secured creditor or lien holder has rights to the collateral ahead of you. If necessary, we can represent you in disputes with other creditors.

To collect on the debt, we can enforce the lien via garnishment, attachment proceedings, seizure, foreclosure and liquidation. However, if a debtor's collateral is wrongfully repossessed or liquidated, the lien holder:

  • May lose the right to collect on the debt
  • May forfeit his or her security interest
  • May be countersued for damages

It is best to work with an experienced attorney to ensure that you do not make costly lien enforcement mistakes. Please call our office at 502-442-7341 to schedule an appointment today.
